All charges against a man in Blue Rapids, Kansas, who flew a "F*** Biden" flag outside his house were dropped Wednesday after the American Civil Liberties Union of Kansas came to his defense.

"F*** Biden and F*** you for voting for him!" the flag reportedly read.

David Sain was charged with promoting obscenity in August after raising a flag expressing an obscene message against President Joe Biden, according to a report.

"You know, I don't know why they are making me take it down," Sain said. "It is my freedom of speech and my First Amendment right."

The ACLU echoed Sain and said the prosecution was unconstitutional and the charges against him needed to be dismissed.

"This was a clear violation of the First Amendment," said Sharon Brett, legal director of the ACLU of Kansas, in a statement. "Each of us, Mr. Sain included, enjoys a constitutionally protected right to freedom of speech."

Blue Rapids also charged Sain with public nuisance, but that must also be dismissed because it relates to his exercise of free speech, the ACLU stated.

The obscenity charge was the first to be dropped in October, and all the others were dropped after the ACLU filed a motion alleging that the prosecution against Sain was retaliatory, according to the report.

"I'm grateful that I can continue to express myself with my flag without the fear of prosecution," Sain said.
