Despite carrying a replica firearm with a knife, the suspect in the attack on comedian Dave Chappelle will not be charged with assault with a deadly weapon, according to a Thursday declination to file felony charges from Los Angeles County District Attorney George Gascon’s office.

The suspect, 23-year-old Isaiah Lee, was arrested after the Tuesday night attack on suspicion of assault with a deadly weapon, according to multiple reports.

Lee was then held on $30,000 bail, the reports noted.

The case was referred to the Los Angeles City Attorney’s Office for consideration regarding a misdemeanor filing because officials determined there was not sufficient evidence to constitute a felony.

According to prosecutors, Lee's actions did not meet the felony standard for assault with a deadly weapon, as he did not present the weapon during the incident.

Gascon’s office does not prosecute misdemeanors that occur in LA, the Los Angeles County District Attorney's Office said in a Thursday statement.
