Billionaire Tesla and SpaceX CEO and new Twitter owner Elon Musk will not testify in the heated defamation case between Amber Heard and Johnny Depp despite appearing on an initial witness list.

Musk's lawyer, Alex Spiro, confirmed to the Washington Examiner that his client will no longer be a part of the trial. He was previously set to give testimony remotely.


Musk and Heard dated in 2016 as she was in the process of divorcing Depp. The relationship lasted for roughly one year before the two reportedly split in August 2017. According to a report, the celebrity couple rekindled five months later, with a source confirming a final split in February 2018.

A source told the New York Post that actor James Franco will not be taking the stand either. A relationship between Franco and Heard has never been publicly confirmed, though Depp said he believed the actors were having an affair during their marriage.

The two were highly anticipated witnesses due to their star power, though the case is certainly not lacking in drama. The Fairfax, Virginia, courtroom has been the site of a vicious battle, primarily between Depp and his ex-wife's lawyers, as the Pirates of the Caribbean actor has testified for a week straight.

Meanwhile, Musk has been making headlines of his own after Twitter accepted his $44 billion offer to buy the platform Monday.
